Kupwara Administration Imposes 11-Hour Daily Ban on Mining in Nallah Mawar Under Section 163 BNSS: Add Your Title

Kupwara, March 13: In A bid to curb illegal mining activities and safeguard public infrastructure, the District Magistrate of Kupwara, Ayushi Sudan (IAS), has imposed restrictions on the extraction of Nallah material from Nallah Mawar between 7:00 PM to 6:00 AM. The order, issued under Section 163 of the Bharatiya Nyaya Sanhita (BNSS), will remain in effect for three months.
The decision follows concerns over unauthorized mining operations, particularly near bridges, water reservoirs, and other public infrastructures, which pose a threat to both public safety and law & order. The administration has noted that illegal extraction during nighttime hours has been increasing, violating environmental guidelines and potentially leading to damage to key structures.
The order mandates the Senior Superintendent of Police (SSP) Handwara to ensure strict implementation of these restrictions. Furthermore, the directive aligns with National Green Tribunal (NGT) guidelines and Supreme Court rulings regarding mining regulations.
The move is expected to prevent environmental degradation, protect essential infrastructure, and ensure the safety of local residents. The district administration has urged the public to cooperate with the authorities and report any violations.
Copies of the order have been forwarded to relevant officials, including the Divisional Commissioner Kashmir, Director of Geology & Mining, and Additional Deputy Commissioners of Kupwara and Handwara, for necessary action.
The District Information Office has been directed to publish the order in leading newspapers and local media platforms to ensure widespread awareness among the public.
Section 163 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, empowers Magistrates to issue orders in cases of nuisance or apprehended danger, preventing obstructions, threats to human life, public disturbances, or riots.
The Kupwara administration has urged the public to cooperate and report any violations. This strict measure reinforces the district’s commitment to environmental conservation, public safety, and infrastructure protection.
